Penalties for Assault in Texas
Assault is a crime that does not require physical contact between the accused and the alleged victim. All that is needed for an assault charge to be filed is for someone to have a reasonable fear of bodily injury. In Texas, assaults can be charged as either misdemeanors or felonies. The circumstances of the crime determine the charge as follows:
- Simple assault—Assault that causes minor injury. Charged as a Class A misdemeanor and punishable by up to a year in jail and up to a $4,000 fine.
- Third-degree felony assault—Assault involving domestic relationships, public servants, government contractors, security guards or emergency workers. This charge is punishable by 2 to 10 years in prison and up to a $10,000 fine.
- Second-degree aggravated assault—Assault with a weapon and/or causing serious bodily injury. Punishable by 2 to 20 years in prison and up to a $10,000 fine.
- First-degree aggravated assault—Assault with a weapon that involves a domestic relationship, public official, security guard, witness to a crime or an informant. Punishable by 5 years to life in prison.
